1. Applicability

These terms and conditions apply to all agreements between Dear Diary Tattoo (hereinafter referred to as “we”, “us”, or “our”) and our customers (hereinafter referred to as “you” or “the customer”), relating to our services, jewelry, gift cards, and other products.

3. Appointments, Deposits, and Cancellations

3.1 Customers can book tattoo or piercing sessions and purchase products through our website or other designated channels.

3.2 A deposit of €100 is required to secure a tattoo appointment. This amount will be deducted from the total tattoo price.

3.3 The deposit is non-refundable, except in cases where the customer cancels or reschedules in time, as described in Article 4.

3.4 When our tattoo or piercing services are booked for an external event, the following additional terms apply:

• A deposit of 50% of the total amount is required to confirm the booking.

• The event organizer is responsible for obtaining GGD (Dutch Health Service) approval for the event location at least two months in advance.

• Cancellations or rescheduling can be made up to two weeks before the event. For cancellations after this period, the deposit will be forfeited.

4. Cancelling or Rescheduling Appointments

4.1 Appointments can be cancelled or rescheduled free of charge up to 72 hours before the start of the appointment, with the deposit remaining valid.

4.2 For cancellations or rescheduling within 72 hours, we reserve the right to keep the deposit as compensation for lost time and potential costs.

5. Provision of Services

5.1 We will make every reasonable effort to perform the tattoo or piercing session at the agreed time and date.
5.2 You acknowledge that the final result may vary depending on factors such as skin type, aftercare, and individual healing.

6. Sale of Jewelry and Products

6.1 We aim to provide accurate product descriptions and up-to-date information on the availability of our jewelry and products.
6.2 Products may be returned within 14 days of receipt, provided they are unopened and in their original condition.
6.3 Earrings and piercing jewelry cannot be returned for hygiene reasons.
6.4 Return shipping costs are always the responsibility of the customer, unless otherwise agreed in writing.
6.5 Returned products must be unused, in their original packaging, and include all labels and accessories.
6.6 14K and 18K gold jewelry is covered by a 1-year warranty against manufacturing defects. Loss, damage, or wear resulting from use is not covered by the warranty.

7. Intellectual Property

7.1 All intellectual property rights relating to tattoo designs, illustrations, and other creative materials created by Dear Diary Tattoo remain the property of Dear Diary Tattoo.
7.2 It is not permitted to use, copy, reproduce, distribute, or modify any design without prior written consent from Dear Diary Tattoo.

8. Loyalty Program

8.1 After receiving six piercing services, you will receive the seventh piercing for free.
8.2 The loyalty card is valid for one year from the date of issue.
8.3 Personal data is processed in accordance with our Privacy Policy.

9. Liability

9.1 We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, products, or the results of tattoos or piercings.
9.2 Our liability is at all times limited to the amount paid for the specific service or product to which the liability relates.

10. Gift Cards

10.1 Gift cards are issued by Dear Diary Tattoo and can only be used for purchases in our stores or online at www.deardiarytattoo.com.
10.2 Gift cards are valid for two years from the date of purchase, unless otherwise stated on the card.
10.3 After this period, the remaining value of the card expires automatically.
10.4 The balance can be checked in-store or online.
10.5 Gift cards may be used to purchase products or services but cannot be exchanged for cash or any other form of payment.
10.6 Any remaining balance will remain available within the validity period.
10.7 Dear Diary Tattoo is not responsible for loss, theft, damage, or unauthorized use of the gift card.
10.8 Purchases made with a gift card are final and non-refundable unless required by law.
10.9 We reserve the right to suspend or cancel gift cards in cases of suspected fraud or misuse.
10.10 By using a gift card, you agree to these terms and conditions.

11. Governing Law and Dispute Resolution

11.1 All agreements between Dear Diary Tattoo and the customer are governed by Dutch law.
11.2 Disputes arising from or related to these terms will be submitted to the competent court in The Hague.

12. Health and Age Requirements

12.1 Customers are required to provide complete and accurate health information when booking or attending an appointment (such as allergies, skin conditions, medication use, pregnancy, or other relevant medical circumstances).
12.2 We reserve the right to refuse a service if we believe it cannot be performed safely or responsibly.

Tattoos

• The minimum age for receiving a tattoo at Dear Diary Tattoo is 18 years.

• Persons under 18 years old may only receive a tattoo with written consent from a legal guardian and only on non-visible areas (not on hands, neck, or face).

• The legal guardian must be present during the appointment.

Piercings

• Piercings are permitted from age 16 without parental consent.

• Persons under 16 years old require written consent from a legal guardian.

• The legal guardian must be present during the appointment.

• If this is not possible due to exceptional circumstances, a signed consent form provided remotely may be accepted by exception.

• Intimate piercings are not performed on persons under 18 years old.

13. Aftercare and Responsibility

13.1 After every tattoo or piercing session, we provide clear aftercare instructions.
13.2 It is the customer’s responsibility to carefully follow these instructions.
13.3 Dear Diary Tattoo is not liable for complications, infections, or healing issues resulting from failure to follow the aftercare guidelines.

14. Force Majeure

14.1 We are not liable for failing to perform our services on time or at all if caused by circumstances beyond our control, such as illness, technical failures, pandemics, natural disasters, or government measures.
14.2 In such cases, we will contact you as soon as possible to reschedule the appointment.
